Where will you institute a Civil Suit ?

Suits to be instituted in the competent lowest grade court - Sec 15

Suits to be instituted where subject matter situated - Sec 16

If immovable property within the different court suits to be instituted in any court                                      - Section 17

Local limit of jurisdiction uncertain

– In any court  if court is satisfied          -  Section 18

Compensation (ÿwZc~iY) suit if wrong done and defendant resides in different local limit of jurisdiction     

- Any court                                             - Section 19     

Where defendants reside or cause of action arises

– any or every court                               - Section 20

Jurisdiction of civl court- Section 19 of Civil Court Act 1887 as amended in 2016:

1. District Judge:

Can not receive                – Original suits (আদি বা মূল মামলা)   

Can receive                      - Appeal suits

Pecuniary jurisdiction      - 5 Crores

2. Additional District Judge

Can not receive                – Original suits

Can not receive                - Appeal suits

Can receive                      - Suits only transferred by District Judge   

3. Joint District Judge

Can receive                           – Original suits

Can not receive                     - Appeal suits

Pecuniary jurisdiction            - Unlimited

4. Senior Assistant Judge

Can receive                           – Original suits

Can not receive                     - Appeal suits

Pecuniary jurisdiction            - 25 Lacs (As amended in 2016)

5. Assistant Judge

Can receive                           – Original suits

Can not receive                     - Appeal suits

Pecuniary jurisdiction            - 15 Lacs (As amended in 2016)
