Parties to civil suits

Order 1 of

The Code of Civil Procedure 1908

There are 2 parties (পক্ষসমূহ) in Civil suits
1. Plaintiff (বাদি):

• Who institute a suit
• Who demand right or relief
• Plaintiff may be one or more 
• One person can conduct suit (পরিচালনা) for all with the approval of the court.
• 
  

2. Defendant (বিবাদি):

• Against whom a suit is instituted
• Against whom right or relief is demanded
• Defendant may be one or more 
• One person can conduct suit (পরিচালনা) for all with the approval of the court.

Misjoinder of parties (পক্ষ সমুহের অপসংযোগ):

• Parties not necessary in the suit but listed in the suit
• Suit is not defeated for Misjoinder 
• Can be amended at any step of suit

Nonjoinder of parties (পক্ষ সমুহের অসংযোগ বা অভাব ):

• Parties necessary in the suit but not listed in the suit
• Suit is not defeated for Nonjoinder 
• Can be amended at any step of suit
